TB TEST EXEMPTION FOR RESIDENTS RETURNING WITHIN 2 YEARS

Hi, I want advise on a situation. I am skilled worker and applied visa for my dependents. My wife have been in uk on student dependent visa and exit UK on 3rd Dec 2023. Her dependent visa expired in June 2024. Meanwhile I switched to skilled worker visa and now applied for her dependent visa. Its been 1 year and 8 month she is out of UK. As per UKVI guidelines on TB test "UK returning residents do not required tb test if they have not been out more than 2 years. As per their guidelines she is exempt from tb test. However caseworker still requested tb test as additional document within 10 working days. I have already attached a letter with application about it gave provide copy of Pakistan entry stamp and their ticket of exiting uk. I even added a note in application form aswell ad additional information. What should be done now?

The Gov.UK link that you linked to has not explained the rules in a helpful way.

A Returning Resident is a person who held ILR in the UK and is returning to the UK after their ILR lapsed while outside the UK.

As your wife never had ILR, she is not a Returning Resident and needs to meet the usual TB test requirements.
