Private life visa for child

Hi,

I have a child who has arrived in UK Oct 2017(Age - 20 months when arrived in UK). Child is continuously living in UK since then dependant on parents's visa (sometimes on me , sometimes on my spouse dependant). We are still in UK with valid visa.

My queries are below :
1. Child eligible for ILR? if not then When?
2. Can we file Private life visa for a Child and be dependant on Child's visa, what are the requirement for this?
3. What are documents / criteria list for it.

Can anybody explain elaborately.

1. Your child does not qualify for Private Life ILR route. The child will qualify for ILR when you and your spouse do.

2. No you cannot apply for a Private Life visa for the child as both you and your spouse hold Skilled Worker Visas. The child follows the same immigration path as you and your spouse.

There is no magic route for your child to get ILR quicker.

No you cannot. This route is not available to your child as you and your spouse both hold Skilled Worker Visas.

A private life application for a child looks not just at seven years residence in the UK, but also at whether it is reasonable for the child to leave the UK, their family connections to their country of return, etc.
Private life caseworker guidance wrote:The assessment must be specific to the child’s situation. You must consider,
  • the age of the child
  • whether the child has ties to the UK including relationships with other family and friends whose lives are established in the UK
  • who the child would be expected to leave the UK with – it is normally in the best interests of the child for the family to remain together
  • whether they have family and friends in their country of return
  • whether they have ever visited the country of return, for how long and when
A grant of permission to stay to a child on private life grounds does not mean any parental permission to stay will be of the same duration.
