Clarification Needed on ILR Application Date Under COVID Concession

Hi Team,

I am currently on a Skilled Worker visa and I am seeking guidance on when I can submit my ILR application.

Date on BRP: 28 April 2021
Date Skilled Worker application was submitted: 30 March 2021

I have heard about the COVID concession scheme (SW 21.2), which states that any application submitted between January 2020 and June 2021 allows applicants to count their qualifying period for settlement from the date the application was submitted, rather than the date biometrics were attended or the BRP was issued.

I would like to know if I can still benefit from this concession. Specifically, can I apply for ILR 28 days before the application submission date (30 March 2021), in order to avoid any risk related to the new rules that may be implemented from April 2026?

Although I understand I should still be eligible under the new rules, I want to be cautious and avoid any uncertainty.

Yes, you can benefit from the COVID concessions. Also, the 28-day concession has very little to do with when you apply for ILR. You will become eligible for ILR on (30 March 2021 + 5 years - 28 days)

Just for clarity as you didn't state the info, was this an application within the uk or from abroad?
