HSMP new 4 year judgement - Clarifications needed urgently

Hi All,

I have come to this country on HSMP on 2005 july. So, according to the new judgement i am eligible to apply for ILR (Permanent Residency) because i have almost completed the 4 years term.

1) Is the judgement final and people like me can get the ILR successfully or do we need to wait any further?

2) Do I need to write the test "Life in UK" ??

3) Can I apply for my Wife's ILR also? (She is HSMP Dependent now and completed 3 yrs in this country).

4) If i can apply for my wife's ILR also, does she need to give the "Life in the UK" test too?

5) How many months before the 4 yrs team i can apply. I am due to complete my 4 yrs in this year July so, can i apply now because its only 3 months left now.


As these are common questions everyone have it would be much appreciated if anyone can share their thoughts.

HSMP forum has written to UKBA for the implementaion of the judgment and in that letter they have asked them not to ask for tests from the people who came to UK on HSMP before April 2006.

Home office will be preparing a Policy document and implement the judgment. I believe they have 42 days from the date of judgment for implementation.

You can apply 28 days in advance of completing your 4 years. I am not sure about if your wife can apply with you, I think she should be able to, and if the test is required both of you will have to take it. Only children (I think below the age of 16) are exempt from the test.
