Appeal maintenance fund internet print

Post by seamanbuk » Sat May 09, 2009 8:46 pm

Hi everyone
it's great to found this place, need your help please.

uk tier 1 (general) leave to remain got refuse: maintenance fund issue
bank statmnt, some of the statmnt print out by myself without bank stamp, so print out part couldn't be consider, no points in that section.

in fact these were a well amount in my acc in tot, but in different ones (some of print out, some of originals)

want to appeal:

Qs 1: appeal make on what grounds?
it says in section c: right of appeal, but which one? the decision is not in accordance with immigration rules?
well it's Guidance, Not Law or Immig Rules, can I argue it on that?
or what?

Qs 2: grounds
(originals bank stamnts to approve the my own print and extra stamnts cover until now)
should i send all grounds to AIT with AIT 1 form OR
send extra stamnt to AIT 5 days be4 my hearing day?

Qs 3: there are always a good amount in my acc, but is this a strong case to win?

many thanks for all your posts, give me a faith to argue.
good luck for everyone here.

Hi,

It is mentioned clearly in the Guidance that Bank Statements should be either in Original or verified(stamped & signed) by Bank.
Since you have not submitted as per the above mentioned criteria, your application was bound to get rejected.

Now your question:

1. No you cannot argue on the Immigration Rules. As reference to these rules are mentioned in the guidance notes. These is not point arguing on matter which doesn't help you.

2.Yes, you can send extra statements to AIT. Make sure you send these statements signed+stamped or Originals (which can be verified). Also include letter from your bank corroborating the statements.

3. I think people, similar to your case, in this forum have appealed against the decision and overturned the decision. So in my opinion there is good chances. Appeal through a lawyer.

Wait for other members to respond on this.
