ILR or spouse visa?

Hi

I was granted ILR (long residence 10 years category) last week. My husband has been on dependant visa for the past 8 years. My question is should he be applying for spouse visa now and after two years apply for ILR? Or, because we have been married 8 years and he has been in the UK for 7 and a half years, is he eligible for ILR directly?

Secondly, we have been submitting our original marriage certificate for all the visa applications. This is in English and was issued in India. Does this need to be attested by the Indian High Commission (although the home office have been accepting the original without any attestment in the past)?

The 4 years for ILR needs to have been outside the UK, so he'll need to get a spouse visa.

Have you any UK born children?

Will have one in 4 weeks. Would that have any bearing on his status though? I understand the baby will get British citizenship automatically.
