Naturalisation Query. Please help

Post by RamuKaka » Wed May 20, 2009 9:17 pm

Hi,

Under the HSMP Forum Ltd judicial review judgment, Am I eligible to apply for naturalisation?

Following are the visa details:

1 Yr - WP (2003 - 2004)
1 Yr HSMP (2004 - 2005)
3 yrs Extension (2005 - 2008)
and for last 5 months I am on ILR.

If I am eligible, could you please point me the location of documents/forms?

Appreciate your help.
Kaka

Normally, you require at least 12 months' on ILR, unless married to a British citizen. However,
Migrants who have already settled in the United Kingdom under the HSMP or Tier 1 (General) on the basis of having completed five years continuous residence in a qualifying category wrote:In addition, if you apply for citizenship in the future, you will be considered to have been settled in the United Kingdom from the point when you first completed four years qualifying residence. When we send you your one-off payment, we will also send you a letter to confirm this. If you apply for citizenship, you will need to send the letter with your application as confirmation of your position.

Hi,

I'm in a similar situation too.

2 Yrs Work permit (2003-2005)
3 Yrs on HSMP (2005-2008, one extension only)
5 months ILR (late 2008)

Does the HSMP judicial review allow us to combine the work permit and HSMP years to bring our 'ILR qualification date' into 2007?

The guidance notes tend to suggest that to qualify for the JR ruling the applicant must have started on HSMP from the outset, however it's still a bit unclear as the policy notes released before the guidance notes say otherwise. If we are covered how do we get our hands on this letter that states our circumstances?

If I can I would like to naturalise before the citizenship bill is passed without clause 39!
