Work Permit to Tier 1 General

Post by vinayb » Sat May 23, 2009 8:22 am

Hello friends,

Below is my case. I would really appericiate any help/advice you can offer.

1. I am working for a company since 2.5 years now.
2. After completing my studies, I started full time work for my employer.
3. When my Post Study work visa was about to expire, My company allowed me to work from my home country, thus I went back home, and used to work from there. (still getting UK salary in UK Bank)

4. After 9 months of work from Home Country, the company sponsered for my Work Permit, which got approved - 5 years

5. Now after a few months of work (less than a year) in the UK, on work permit, I wish to move to an Tier 1 General Visa (a employer independent one)

The Problem:

To apply for a tier 1, i need to show my one years earnings, which in my case as all in GBPs (though I was not in the UK for a major part). According to a clause in the guidance - "Earnings made from United Kingdom employment will only be considered if the applicant had leave to enter or remain in the United Kingdom at the time they were earned, and in a category which permitted the applicant to take that employment.

I am not the Director of the company.
Found this from :http://www.ukba.homeoffice.gov.uk/sitec ... 310309.pdf Page 22"

Thus, i fall short of points. I have no home country earnings.

Any help would be greately appericiated.

Looking forward to hearing from you...
