Can my wife apply for ILR with me?

Can my wife apply for ILR with me?

I am working in UK for five years as work permit holder and will apply for ILR next month. My wife is also a work permit holder and she has lived with me for the last two years. Our baby was born in UK this year.

My question is: is there any possibility that my wife can apply for ILR together with me and my child? If rejected, will it affect her later application for leave to remain as my dependent if my ILR is granted?

Unfortunately, no. She needs to have leave as your dependant (i.e. entry clearance as your dependant) in order for her to be included in your settlement application (196D).

However, after you are granted ILR, then she may switch.

yes your partner can switch once you have got ILR ....they may give your partner 2 years(probationary) visa..and then you could apply for ILR ...


But new citizenship law would increase that to 3 years if that 2 years period end after july 2011....

what a pain....
