Sponsorship Issue - US - Family Based - Tax issue!

Post by freshair » Tue Sep 15, 2009 2:49 am

My wife and I were married last year in US. We recently filed all the forms for the I-485 AOS and have an approved I-130. We received an RFE for tax related issue on the I-864 (sponsorship).

I'm the sponsor but only included the last 2 year tax returns (2008, 2007, no IRS transcript). Do I need to include 2006 (all three years) and include the IRS transcript?

Also, I didn't earn income for 2006 and haven't filed. Should I file the tax return now and include it along with the IRS transcript?

One more issue... I'm a qualified sponsor for 2007, but not 2008. Only earned $10k. I need to have assets valued up to 3 times of the difference.

I submitted an appraisal for a diamond worth over $40k, which I own. I have other jewelry to submit if needed.

2008: $10k - Filed & submitted
2007: $23k - Filed & submitted
2006: $0 - not filed, not submitted

Assets: $40k (appraisal)

How to proceed? Thx!
