Baby born outside UK

Post by vinodronak » Sun Sep 27, 2009 5:47 pm

Dear Members,

Me & my wife are ILR holders (thourgh HSMP Judicial review). My wife is planning to give birth in India in Feb 2010. Both me and my wife will be eligible for applying British citizenship in April 2010. I have 3 questions

1. Under what status can i bring my child to Uk.(I assume it is ILR)

2. Can we apply for citizenship for the baby asweel when we apply for me & my wife in April 2010.

3. I am not sure but i think they might give citizenship to the baby in April 2010 under Home office discretion. I want to know what are chances for them to reject citizenship for the baby under Home office discretion.

Thank you

Regards
Vinod

1. Child may apply for child settlement visa. Should be granted ILE as both parents have ILR.

2. Yes.

3. Chapter 9: Registration of minors at discretion.

Note that: Automatic British citizenship if baby is born in the UK.

Thank you for your reply.

In my our case what are the chances of childs citizenship being rejected if both me & my wife get it.

Is there any specific things that home office would look at before deciding to reject my childs citizenship.

Thank you once again
