I have a situation where my brothers girlfriend overstayed on her visa in 2003 she remained in the UK illegally.

My brother (british born) met her two years ago and they have since had a child together (british born) he did not know she was here illegally until the baby was born.

can we make an application under article 8 to the home office to allow her to stay here legally?
