ILR DOCUMENTS-WORK PERMIT & SPOUSE VISA***URGENT SITUATI

Dear all,

Would sincerely appreciate if you can assist me with my queries:

My wife and I both got work permits on 10 June 2005, hence our ILR will now be due in a few days. My wife has continually stayed on WP throughout with just 1 change of employer (with no gaps) whereas I stayed on WP till January 2008 and then switched to Spouse VISA in Feb 2008 as we got married. Now with ILR due in a few days, I have some doubts:

1. What documents will my wife need to submit for her application? (Work Permit-5 years). I checked a lot of threads but if someone could give me a list specific to her case then will be fantastic? As in bank statements for how long, salary slips for how long etc etc

2. Can she just add me on her Application and we get ILR together OR do I need to submit a separate application?

3. What documents will I need to submit for my ILR as spouse VISA?

4. She has spent around 200 days out of UK in 5 years but with 30 of those being business trips where as I have now spent 195 days out altogether, does that make a difference to my application as a SPOUSE VISA ILR?

5. We plan to get an SAME DAY PREMIUM SERVICE. Is the case straighforward for that?

I would really appreciate if the 'knowledgable' people here could please assist me with my queries as we are now due in another few days!!!!

Also, can I just give a BIG thumbs UP to everyone who contributes on this forum, Its a great resource for fellow people in need. Thanks!!!

2). You can be included in her application if are on dependant visa to the work permit holder
3). Need marriage certificate
4). Maximum allowed absence is 180 days, you can exclude your business trip by providing a letter from the employer confirming that the absences for business purpose. She should have been paid in UK, paid tax and NI during the absence period. Spouse doesn't have any absence limit. Note: you can exclude departure and arrival date from her absence.
5). If you prefer to apply at PEO, the decision may not be taken at the same day as it may require further investigation. You may end up paying premium fee for the postal application. Apply by post.

Hi Thanks for your reply. Now I have gone through the form link you gave and have questions as below?

1. Your current passport
2. The current passport(s) or travel document(s) for each dependant
3. bank statements (For how long??)
4. pay slips (For how long)
5. other formal documents as evidence of your ability to maintain and accommodate yourself (Like What???)
6. A Life in the UK test pass notification letter
7. A relevant ESOL qualification (If you do a Life in Uk test, what do I need to give for this????)
8. Recent document(s) from the employer named in your current work permit confirming that you are still needed and that your employment with them is continuing. (Just a letter confirming start date, name, salary, position etc.??)
9. Document(s) confirming that you have spent a continuous period of 5 years in the UK:
- either as a work permit holder throughout that period (What documents can I submit here and what periods do they need to cover?????

Please clarify, sincerely appreciated!!

4. pay slips (For how long) (all your p60's and last 3-6 months payslip)
5. other formal documents as evidence of your ability to maintain and accommodate yourself (Like What???)(you bank statements if tenents then carry your tenent agrement (i had my land registry document but they dint ask as bank statement did)
6. A Life in the UK test pass notification letter (you and your wife will have to pass this one if you do not give this test then you should undergo ESOL course. SO long story short you need either life in uk test letter or ESOL letter)
7. A relevant ESOL qualification (If you do a Life in Uk test, what do I need to give for this????) (if you have life in uk then this is not required)
8. Recent document(s) from the employer named in your current work permit confirming that you are still needed and that your employment with them is continuing. (Just a letter confirming start date, name, salary, position etc.??) ( format for this is in this forum. I used same format and it worked for me :)
9. Document(s) confirming that you have spent a continuous period of 5 years in the UK:
- either as a work permit holder throughout that period (What documents can I submit here and what periods do they need to cover????? ( your employer letter will have start date and end date and ask him to add another line saying has been in regular employment for that period)


Another thing you said you wife is on work permit and she had one employer change. So in this case did she get another work permit for the new employer. you will have to carry your home office letter for your first employer + current employer
