Spouse's time in UK for ILR?

Spouse's time in UK for ILR?

Dear Friends,

I am becoming eligible for ILR by end of June 2010. However, I have a question about my wife's eligibility:
  • I got married in April 2008 in India and my wife has joined me in UK after 2 weeks of marriage (May 2008).
  • She went to India in Jan 2009 and stayed there for 3 month (for her exams)
  • She joined me back in April 2009 and we lived together in UK till March 2010.
  • She went back to India for her pregnancy in March 2010 and is due to be back in UK in September. (We were blessed with a baby girl in first week on June)

I am now planning to apply for ILR in September when she and baby are back in UK.

By September 2010, we would have been married for 30 Months and our of that she has live in UK with me for about 20 months.

Please let me know if she would be eligible to apply with me and baby for ILR in September.

on what category are you applying for ILR?

the rule is wife should have been here for two years before applying for ILR... the two year period starts from the first time she came here, in your case May 2008. Her subsequent out of the country days will not affect your application as far as i know...

You will be OK to include wife & Kid in your ILR application in September...

I am applying under Tier 2 (Intra Company Transfer); Previously I have been under erstwhile Work Permit.

Can you please guide to me the link, possibly on UKBA site where I can find this guideline?

As for as I know, there is no limitation on dependents. As for as they have valid visa and staying in UK with applicant when applying for ILR that should be sufficient. In application, only applicant abscence has to be filled in and not dependents..
