Fiancee visa and pulic funds condition

Post by can889 » Mon Jul 05, 2010 9:47 am

I'm after some advice on the public funds condition for applying for a Fiancee visa.

The 2 clauses state
There is somewhere for you and your dependants to live until you get married or register a civil partnership, and you will be able to live without help from public funds.
You and your dependants can be supported without working or claiming any help from public funds.

At the moment, I live alone, so i get the 25% discount on council tax. Does this count as getting benefit or claiming public funds? Obviously when my fiancee comes over I will inform the council and pay full council tax. But this won't effect my application will it? As I will be submitting my council tax bill as part of proof of accommodation.
Or should I get a new council tax bill with the discount removed.

Thanks for the advice

No this does count as claiming benefits.

If the Council was paying you rent or all of your Council Tax then it would be deemed as claiming public funds.
