I hope you can kindly assist me again here;
I'm a British citizen and i was intending to go back with my partner to her home country and get married in December and apply for a spouse visa. He has however been in the legacy queue has received a letter yesterday asking her to submit 4 passport pictures as her case is due to be concluded soon. She has now been in the UK for 10 years.
The only problem is she used a different nationality when she claimed asylum 10 years ago but we were intending on coming clean when we go back to her country in December.
My question is should we fill in the legacy form, come clean and inform them of our prior intentions of getting married and hopefully she gets granted or simply ignore the form and press ahead with our December plans?
To be honest if they attempt to remove her we are prepared to pay the cost and return voluntarily and bring the December plans forward.
Has anyone had an experience of someone being granted under legacy after coming clean about a previous deception or is it a straight refusal?
