I switched my Post study Tier 1 to Tier 1(General) visa in late April2010 valid till April 2013(old rules). My post study visa was valid till November 7th 2010 and my wife’s as Post study Tier 1 partner visa up till same date 7/11/2010
My wife did not apply at the same time when I applied (In April) as her mother is suffering from critical illness and she might had to travel anytime to India. I made PEO appointment in Glasgow for 20th Aug(got so late) to switch my wife’s (Post study) Tier 1 partner dependant visa to Tier 1 (General partner) dependant visa. Case worker there suggested us to apply via post as there is gap of 4 months which is bit more to switch visa and asked us to write nice cover letter to UKBA explaining reason.
He further said it will be mostly successful but he did not process the application as he said they take only straight forward applications. He said he is not rejecting visa or refusing and did not even take fees. He just said apply via post as they have discretion and more power to grant visa in this case because home office does not want to part families. There is no problem with documents and maintenance of funds. Funds have been much more than required for last 6 months up till date.
Moreover there is nothing mentioned anywhere in PBS dependant form or policy guidance regarding any time frame in which wife should switch the visa. I called PEO and they said you should apply as soon as possible but no time frame.
It will be really great help if any nice soul could guide me for the next step like explaining in cover letter for the gap or anything else to support application. Thanks for reading....Seniors plz guide....

My wife havent got her tier1 dependant visa yet and its 4months since I got tier1. We are not very sure how to go about it. If you have found some answer to your query , please help us.

I understand there is no mention anywhere about time frame, but its logical to switch your dependant visa as soon as you (main) applicant switches category.
Probably you should give some valid reason for your delay in cover letter.
