Switching from Tier1 Gen visa to spouse's ILR application

Post by omerabdul » Mon Feb 21, 2011 11:32 pm

Dear members,

This is rather a strange query. I will appreciate if anyone could shed some light on it.

I am on work permit since Dec 2006. In Jan 2012 I will be applying for my ILR. I would like to include my wife and my son as my dependent. However my wife is currently on her own Tier 1 General visa which will expire on 01/02/2012. My wife first came to UK in Aug2007 as my dependent, and then she switched to Tier1Gen on the 01/02/09. My wife and son are in India now spending maternity leave for 6 months (not more than 3 months at a time).

Can my wife join my application as my dependent in Jan 2012 or she must go back to India to file her application. Thanks
Omer
