Tier 1 dependant application in-country query

Hi
I am about to apply for my son's dependant visa and have all the documents ready but one query outstanding!
My son's passport was issued at the Birmingham Indian consulate. We travelled to India last month and my son is still back there, but I have brought his passport along with me inorder to make this application.

Now my question is whether it is okay to make the application considering my son is not physically in the UK - there is no section in the application about where he is currently but do they check the immigration stamps etc?

No.

Applicant(s) physically present in the UK can make (or be included in) a leave to remain application.

I think this is very stupid. Its illegal to send your passport out of the country from where you are. I think you should discretely send it back to India.
