Two questions needs your attention please

1. Does a tier 1 general migrant has to be economically active all the time during his first three years of stay before extention and after that as well (2 years). all together 5 years?

What will happen to those who lose the job and there is 2 to 4 months gap before they become economically active. Does it affect on visa extention or lator in ILR application.

2. Baby born to T1 G migrant, Does he/she has to get a dependant visa in a certain time say within 6 months or so, or can be included when main applicant apply for extention. by doing this newborn will not be considered as illegal.

1. The only time you have to "economically active" is the time directly preceding your extension as you have to show a certain amount of earnings.

If you lose your job, you simply cannot claim earnings for the period (well, since you won't be earning the money) - it is safest to ensure that you take up jobs which put you well above the minimum criteria to ensure sufficient earnings, even if you lose your job or get a decrease.

2. A newborn does not require entry clearance (as they are already here when they are born!).

You have to score points again for ILR now. So employment required for 5th year also.

Do you mean to say, a person has to be working for five years continuously to get ILR,

What I heared to get the ILR a person has to show his earnings, the same earnings which he showed on the time of his last extention

No, you don't have to work for 5 years solid. As long as you worked for a period before your first extension to make up earnings and worked again for a period before ILR to make up earnings, you'll be fine. It is probably just easier working the entire period though...

here is an example which will make it clearer for you

Say you work for 6 months (say Jan 2011 - Jun 2011) and then be unemployed for 6 months(Jul 2011 to Dec 2011) before your extension.

Yes you can do this.

But only if the time you worked meets the income criteria ie. the period Jan 2011 to Jun 2011 you worked.

You would need a good salary to achieve this. Although some people do it in 2 months earning say £20,000/month

for your second question, as long as you infant does not leave the country they dont need a visa. Just include them in your extension application.
