My wise visa (tier 1 dependent VISA) got refused today on these following grounds
You have applied for an entry clearance as the spouse of a PBS migrant. I have considered your application against paragraph 319c of the immigration Rules.
The Decision
It appears from your sponsor's passport that since your marriage you have spent only a maximum 21 days with your spouse as you were married on 26-11-10 and he departed Pakistan on 17-12-10 ,you provided no call records,cards, photographs sicne your wedding,no evidence of regular contact has been submitted at all .you have submitted no evidence to show that you and your spouse are in a committed relation and in view of this lack of contact i am not satisfied that this marriage is subsisiting and that you intend to live with your spouse throughout your stay in the United Kingdom 319C(d)(e)
As laid out in Appendix E of the Immigration Rules,you must show that your sponsor has available £1600 in available funds(per Dependent applying).In aaccordance with published guidance you are required to show that you have held these funds for 90 days .Any bank statements or financial documents you are submitting to meet this requirement must be dated within one month of your application and must be in your name or that of your sponsor .In support of your application you have submitted a bank statement from NatWest that shows that on several dates since the statement began(including the closing balance on 02-06-11) your sponsor held funds of less than the required £1600 .Therefore ,you have failed to provide any evidence showing that your sponsor has these funds available. Iam therefore not satisfied that there is a sufficient level of funds available to you as set out in Appendix E 319 (g).
I have therefore refused your application because iam not satisfied on the balance of probabilities,that you meet all of the requirements of the above paragraph(s) of the Immigration Rules.
They give me the right of appeal ,need your advice that what should i do .
