What's the 5 years relevant period for EEA citizens? P60s

Post by apriliapegaso28 » Thu Aug 04, 2011 2:49 pm

Booklet AN - EEA Nationals:
New immigration regulations on 30 April 2006
An EEA citizen will automatically have Permanent Residence status after exercising EEA free movement rights in the UK for any continuos period of 5 years.
You should normally have held permanent resident status for 12 months before applying for naturalisation, ie, wait for 6 years before you apply.

Guide AN - EEA Nationals:
Evidence of exercising Treaty Rights for 5 years.
P60 tax certificates covering the relevant period of 5 years.

So, if we've got 6 years, what's the relevant period the mention here?
Years 0 to 5 (at which point you'd get the Permanent Residence status) OR years 1 to 6 (which are the last 5 years)?[/i]

The 5 years relevant for the EEA nationals are 0-5 as you need to show that you have acquired PR status one year before the naturalisation application.

Don't get confused with the 5 years of residence needed for naturalisation which are year 1-6. You will need to make sure that you have been physically in the UK 5 years prior to the date the HO receive your application and that you spent less than 450 days outside the UK during those 5 years (year 1-6) including 90 days in the last year (year 6).

Thank you Jambo,

Clearly explained, I was getting confused with the residence period (1-6) and the initial period to prove that you've been exercising treaty rights (0-5).

Many thanks!
