Is the Baby born to uk ILR parent classed as british

Post by rm1982 » Mon Sep 12, 2011 11:51 pm

Hi everyone!
I am a pakistan citizen living in the uk for last 9 years and currently hold ILR since october 2010. My wife joined me in the uk in january 2011 and she has a settlement visa as my spouse until april 2013, she is pakistani too. We had a baby boy born in july 2011. I need to know;
1. Which immigration status is applicable to my son. Do i have to apply for his naturalisation or registeration or right of abode etc.
2. What stages do i have to go through for him to obtain british passport.
3. Is it worthwhile for me to wait until i get my citizenship which im going to apply next month or will it not make any difference to my baby's application?

I will appreciate any and all help so plz if u know the answer then reply.

Thanks.

Child is automatically British, if born in the UK.

I believe the caveat there is, the child has to be born in the UK. If you wife delivered in Pakistan or elsewhere, then the child is not British by birth and you can only apply for naturalisation at the time when you apply for yourself and your wife.
