Tier 1 Extension : advice requested

Hi all,

Required some advise based on my situation as detailed below:

- Initially came to the UK in Jan 2007 on a sole rep visa with company"A"
- Got a job offer in Sept '08 which I accepted and the Company "B" applied for my work permit, I left the UK for 10 days to head back to India as I needed entry clearance again for the work permit.
- Entry clearance was stamped by immigration end Sept 2008.
- In May 2009, I switched to Tier 1 Gen category visa, valid for 3 yrs and the term ends May 2012.
- My spouse and child have been with me in the UK since Aug 2007.
- I moved to company "C" this month.

Some clarifications I needed were:

- Want to apply for the Tier 1extention in early Nov 2011 itself. My thought is, should they give me the extention in Nov itself for another 2 yrs, where the term would end in Nov 2013, I would still qualify for applying for ILR status as I would have the required 5 yrs stay by Sept 2103. Any reason for me to wait till Mar 2012 to apply for the extention? 5 yrs stay - Sept '08 to Sept '13

- I qualify based on the points calculator so again why not apply now for the extention than wait for a month or two before the term expires.

- Would the period I spent as a sole rep from Jan 2007 - Sep 2008 be counted towards ILR to qualify for the 5 yrs stay?

Since an early application still gives you the required 5 years, I'd go for it. With regards to the time as Rep for Company A, I have no idea but I am sure it should be explained somewhere in the usually helpful guidance documents from UKBA.
