Tier 1 (General) Extension – When?

Post by Ducky11 » Fri Oct 14, 2011 10:14 am

Hi all,

I currently hold a tier 1 (General) work permit which expires on 13th February 2012. After getting the 2-year extension, I am aiming to get indefinite leave to remain on 13th February 2014.

I will be booking an appointment with the home office so that I can get my extension on the same day, but will I need to book it on exactly the 13th of February 2012? I know that the criteria for indefinite leave to remain is to have worked in the UK for 5-years, but if I booked my appointment a few days before the 13th then I would not have the total 5-years required (would fall short by a few days). When is the earliest date prior to the 13th of February that I can book my appointment so that I can legitimately have a total of 5-years by February 2014?

Thanks,
Ducky

Do not apply - by post or in-person - earlier than 28 days before the expiry date of current leave.

Thanks for your post! I have taken that into account!

If, due to extenuating circumstances, I were to apply now, or anytime earlier than 28 days before the expiry, would I be be able to apply for a 2nd extension after the first one expires & then get my ILR after that?

Under current laws, there is no limit on the number of extensions one may apply for before becoming eligible for and choosing to apply for settlement.
