What to do next??????

Hi,

I am non eu married to an EU member(Irish Republic) in June 2004. I was granted 5 years residency in Aug 2004 alongside my husband.

I would like to know what to do next as I have been in the UK now for 3 years ( 2years into the residency). I was informed by a friend that I can apply for an ILR this year???????????

How do I get the ILR and will my husband need to apply for permanent residency also. He has been working in the UK for 16years.

We are together for the long term.

Not so .... had you come to the UK on a 2-year spouse visa, then yes, you would have applied for ILR near the end of that 2-year spouse visa. But you didn't, you got a Residence Permit as a non-EEA family member of an EEA national .... so you can apply for Permanent Residence only near the end of the 5-year Residence Permit. (That would have been after 4 years but the rules were changed as from 03.04.06.)

He is certainly entitled to apply for Permanent Residence. However as an Irish national he is really already given that status without applying for it, given the special arrangements, far better than EEA rights, applying just to Irish Citizens in the UK.
