HSMP extension Issue Simple or Complicated not sure

Hello,

I will thankful if someone can guide me on this simple or may be complicated issue i don't know really. Anyway here it goes.

I am on Tier1 (general) Hsmp visa my leave to remain will expire on 3rd march 2013, however home office issued my spouse visa from Abu dhabi and put wrong date which will be expiring 2feb,2013 which is more than one month.

I will be applying for my 2 years extension on this and able to show enough salary before 2nd feb but someone told me that you can't apply before 30 days so I am bit worried what will I be suppose to do then?

1)do i have to extend her visa first and then apply for extension(which means double the money).

2)Ask home office in abu dhbai to correct their mistake ( which I think they wont as the applicant is in UK now and has got the entry stamp already on the visa)

3) Or apply 1feb 2013 and home office will process the application?

I will be very thankful for the reply on this

You can apply to extend at any time. The reason the guidance reccommends that PBS migrants apply no earlier than one month before expiry is that to do otherwise will create a gap in the five year period that leads to ILR (and so create a need to make a second extension to bridge that gap).

However, if you both apply on Feb 1st you will be fine.

You have enough time on your hands, so no harm in making efforts to get the error corrected.

If I apply on 1st feb then 1st march would be 30 days and my leave expire 2 days after which is 3rd march will they be really choosy about it or they can let it go? sorry I am being a bit paranoid just to avoid any last minute surprises to mess up my extension :)

That won't matter. Even if they don't give you back those few days (but of course they will) you can use the same principle when it comes to ILR and apply 28 days before your leave expires.
