For an independently wealthy (by local standards), fifty-something suffering from back pain there is very little chance. She is a person who is under 65, not seriously sick, and is not indigent while relying on your financial benevolence. Those lawyers should have told you this with the suggestion that the case has virtually no merit. If they are suggesting otherwise perhaps they are motivated by the rattle of your purse. Be careful with this as she will blow any chances of further visit visas if she is refused a settlement application. Why not just pay for a nurse to help her with her daily needs?Roopa Khanna wrote: I approached a couple of immigration solicitors, who’re agreeing to take up the case but are charging around 1400£ for this (in addition to 1850£ govt fee). I’m just wondering if there’s any similar case where we elderly dependant visa was granted in these circumstances before making a payment to the solicitors.

I & my husband have our ILR and I’m wondering if I can apply for my MIL’s ILR as well as an elderly dependent while she's in UK, as her back pain has increased, and she's afraid of staying alone in India. In such a case, we'll have no option but leave the country and go along with her.
My MIL’s details:
Age: 59
Financial Status: Independent as she receives her pension, and she also has lands & properties on her name in India. I proved this while applying for her family visit visa.
My MIL has a chronic back pain, and I have all the proofs. She needs someone to attend to her, and she has none to take care in India. We’re wondering if we can apply for her elderly dependent ILR on this basis.

You need to show that you have sufficient income/resources to support your parents as well as yourself and your other family members without having to claim additional public funds.
