EEA2 Advice please

Post by Haiper1 » Tue Jan 31, 2012 7:55 pm

Hi All, I have an in inquiry regarding an residence card. I have been issued with an EEA Residence card which have been issued on the basis of my durable relationship to my girlfriend(ex-gf, spanish citizen), however a year later being of issued the card our relations broke up in July 2010 and i got married to my current wife (Lithuanian citizen) which i start seeing in June 2010 (this why my old relationship come to an end) and in Nov 2010 we got married but i never changed my residence card because at a time i have called HO and asked if i had to apply for a new RC they said there is no need to do that however someone else have strongly advised me to reapply on the basis of my new relationship. The question is do i have to apply outside the UK or can i apply within in the UK?
Thank you very much for your help

You apply for an EEA2 residence card within the UK.

UKBA advise against travelling abroad while the residence card application is being processed (unless for an important reason).

You can continue using the current residence card. As a residence card simply evidence right, it does not confer it. When your current residence card expires, then make an in country application for a new one that will see you through to the fifth year of marriage and residence in the UK. Provided of course you are still in the UK.

After that you can apply for PR.

You can apply if you want to, and yes EEA2 is the correct form.

It is not mandatory.
