how to apply for PSW

how to apply for PSW

im vinay,i need your advice.i trust website bcz,you guys show what is writen on websites of ukba.

In july 2011 student extension, for MBA, refused in oct 2011 for lack of english in CAS

with right to appeal,appeared in court and submitted new cas with english in nov 2011.it was refused as they dont accept new documents which i didnt submit to home office.

now am on second appeal,waiting for decision.

but my visa is expired on sept 2011.but still i am on 2nd appeal and waiting for my MBA results.

Can i apply for PSW as am appeal.on what bases i can apply/or cant apply.

please guide me

Hi Vinay,
It must have been a difficult period for you with the double appeal process. I propose you wait for the outcome of the second appeal. If successful you would then be safer applying for PSW. Because the PSW route closes in April 2012, I understand why you want to rush in your application.

There's a chance that your PSW application would be refused should you apply now. The rules state: "Switching into the Tier 1 (Post-Study Work) category will only be permitted where the applicant has or has last been granted leave as a student." A valid immigration status during your UK study and/or research is a must-have-20 points. See: http://www.ukba.homeoffice.gov.uk/visas ... ligibility

Because you have a pending appeal decision, you are technically legal in the UK by virtue of Section 3D rule. However, section 3D applicants are prevented from making new applications including PSW. The rule states: "a person cannot make a fresh application for leave while they have 3C or 3D leave pending the outcome of a decision on their outstanding application."

but how come solicitors still say,that i can apply for psw in uk.

one solicitor said,"one the bases of discrimption,he will make some paper work and submit to case worker of home office".

almost i have decided to go back to home country and apply,as i am indian.
1.regarding funds,can i show in uk account or in inida.
2.can i show some funds from mothers accounts.
3.its bit hard to show 3 months in india on my name.
4.few funds in uk and few funds in india on my mother name?
5.if i apply from india,any chances of rejection as i was on appeal in uk.
