Spouse App refused- English TEST not on approved list

Hi can anyone help. If a spouse visa application is refused on the basis that the English Test A1 is not on the approved list can you submit a new test at the appeal.

This is an in-country spouse visa application. The English test was not on the list but it was a test above A1 level. The application was refused on the basis that the English requirement is not met as the test is not on the approved list. After refusal, a test was done that appears on the list and it has been lodged with the appeal grounds. Will the Tribunal disregard this or will they accept it ?

Would it be better to make a fresh application whilst the appeal is outstanding and submit the new test. is this possible?

What would be the better option?

Yes, you can. They have the ability to consider it at tribunal under section 85(4) of the 2002 Act.

We just had the same refusal because of incorrect english test cert.

What happened for us is we applied for the appeal online and then the court informes you to send COPIES of your evidence (copy off the new english test certificate in our case) to them and the other party (home office @ angel square).

Straight after sending this we were informed by the home office that they have withdrawn their decision = end of appeal.

So now we are back waiting for a new decision regarding our FLR(M) visa from home office.

This was our recent experiance and i hope this helps.

Can i apply under the same circumstances, my wife FLR(M) visa rejected with no right of appeal given her visa expiring April 2016. Can we ask tribunal or court for right of appeal.

English test is not in approved list simple reply from HO. Is there any chance i can ask HO to accept my previous application because mu dependant is pre july 2012 and application submitted pre 5april 2014. Thanks

Now i got Trinity A1 certificate, if i send them A1 with reconsideration letter , so is there any chance i can get visa on my previous application. Also i don't know the name of the case worker but i kept the envelope which contain address so will it be sufficient. Do you have any letter format because i don't know what to write. Please reply....
