EEA national, passport for child

Hi guys,

I am an EEA citizen with Residence Permit (not Permanent Residence) in the UK. So is my wife.

Our child has just born and I wonder if we can get the UK citizenship for her on the basis of Residence Permit.

And if not, how to do it when we get Permanent Residence after 5 years of exercising treaty rights in the UK? Do we have to register the child or just apply for the passport?

Should we get Residence Permit for the child as well?

Your child is not a British citizen yet - the child can be registered as a British citizen after ONE of the parents obtains permanent residency (PR).

How long have you and your wife been in the UK, and what nationalities are you both? The child might be able to register for citizenship with one of your nationalities (but we won't know until you tell us your nationalities!).

After one of you obtains PR, to register the child for British citizenship, I think you use form MN1 (taken from here http://www.ind.homeoffice.gov.uk/applyi ... dguidance/ ):

Well then apply for Polish citizenship for the child - is that possible? I don't know about residence permit for the child, but I don't think it is necessary. Anyway, after one of you obtains PR, the child can be registered as a British citizen.

Also - does Poland allow dual nationality?

In that case, once you have clocked up five years working in the UK you become Permanent Residents automatically. At that point, you can register your child as a British citizen. (ie around 2010)

You will be eligible for British citizenship by naturalisation a year later. (in 2011).

In the meantime, the child needs a Polish passport.

You can but do not need to get a Residence Card for your child.

If you are planning to travel outside the EU you would need a passport for the child. If you are not planning travel outside the EU, an ID card or children's ID card from the Polish government will be enough (and may be cheaper).
