Dear Manci

Iam in Tier 2 ICT established staff visa since nov 2010 (ICT), visa valid till dec 2015 with the same sponsor.
am going to india and work for same sponsor few more months.
am i eligibile to apply tier 2 general from india through another sponsor (obviously i will resign the current company)
or do i need to be in UK and apply from here through different sponsor.

or is there any cooling period will apply if i go to india in order to apply tier 2 general?

You can switch to Tier 2 general if you are able to find a sponsor. If you apply from within UK, cool-off will not apply. However, if you go back to India, you will have to apply for an entry clearance visa from India which means that the cool-off of 12 months will apply for you.
Switching in-country is a better option if you already have a sponsor.

Dear Manci,

Inline with the below mail, having tier 2 ict since nov 2010 (visa will expire in nov 2015) - tier 2 established staff.
1. assume if i continue here in uk, i can very well apply for another tier 2 ict extension before nov'15.
if current sponsor doesnt agree for extension of tier 2 ict, moving to tier 2 general is only option in order to get ILR in 2020.
once i apply tier 2 general and get the visa, i can resign from the current company....

2. assume if my company (those who sponsered t2ict) wants me to go back india in july'15 and ask to work permanently in india.
then i believe i cannot apply for tier 2 general from india as i will be having cooling period , entry clearance from india.

can i fly to UK before Nov 2010 (as having valid tier 2 ict) and then apply for tier 2 general in UK by getting hold of sponsor. once i get tier 2 general i can resign to the old sponsor. is it legally permissible travelling to UK without the current sponsor (tier 2 ict )approval? obviously company doesnt allow to grant permission to fly and applier for another sponsor if resource explains the reason for travel. even if i resign from that company, then i cannot travel to uk and apply for tier 2 general. as soon as i resign iter 2 ict will also stopped. Please advise

< you can but if your ICT sponsor has notified UKVI of your end of employment in UK you could be stopped while entering the UK. Experts can clarify>

you already had a reply by "poper" (see above). Once your T2 ICT sponsor notifies UKVI of the end of the employment you cannot use your visa for entering the UK

but my query is can we come to the country legally from india (you have valid tier 2 ict) and apply tier 2 general and then resign here.
generally company may not allow if you tell them that you are going to fly and apply for tier 2 general in uk.
at the same time if you apply tier 2 general from india, the continuty will be broken and fresh entry is considered....

almost i completed 5 years in ict since nov 2010 atleast 2 more years in tier 2 general would fetch FLR (FP)
only problem is companies generally wont extend tier 2 ict for 10 years continously, they will propose rotation, so this time july 2015 they will send back. my plan is come here in sep or oct and applier for tier 2 and then resign.
but is it legally allow to fly?

please advise.

if the company sends you back to work in home country and informs UKVI that they no longer sponsor you for working in the UK then your visa will lapse. The airline may allow you to fly but border control will not allow you to enter. If the company sends you on an overseas assignment and merely informs UKVI of the temporary change of workplace then your visa remains valid and you can return to the UK.

Note that since your initial visa was issued under the rules after 5 April 2010 your time on T2 ICT doesn't count for ILR
