Important Employment query

Hi all

I am planning to employ a worker who has a Spanish national and holds a Spanish passport. I wanted to check if we can employed EU nationals in our business.

Also, can you make an employee in your business work for 45 hours per week and another person for only 15 hours per week. Do you still fulfil the requirement for the correct number of employment hours as require day the UKBA for your business.

Please advise whether you think the above action is valid as per HO guidance or needs to be in a different way.

Also we got our initial application approval before 6 April 2014.

All responses will be appreciated in relation to the above.

Employing a Spanish national is fine, but both your employees must work full-time. The example that you gave would not work as one employee is just part-time.
For example, one employee working 30 hours and the other working 40 hours, both working 30 hours, etc will be ok. Basically, each job role must provide 30 hours of work per week to employee(s).
Another option from the caseworkers' guidance:
You must consider the following as acceptable employment:
 the working hours of 2 part-time workers can be combined to add up to 30 hours a
week or more and form the equivalent of one full-time post, as long as the 2 part time
jobs exist for 12 months

employ:
 one worker for 24 months
 one worker for 6 months and one for 18 months

I have had 1 full time employee doing 40 hours and currently have 2 employees one doing 22 hrs a week and other 20 hrs a weeks.

at the time of apply.......

1 full time employee for 12 months already terminated.

1 will be 16 months part-time 22 hours a week
1 will be 6 months Part-time with 20 hours a week.

will this fine ?? 2 part-time makes it 23 months but doing enough hours to fulfil 1 job requirement.

Apologies for the delayed response and thank you very much for your responses. I will be doing the needful to make sure my business abides by the employment creation rule set out by the Home Office as confirmed by you all.
