P60 and HSMP Application

Hello everyone,

My friend needs help and I would like to hear your view on this. She received her work permit last April (2006) and in the first two weeks, her employer paid her through a managed payroll company as HR was taking a while to do her paperwork and they wanted her to start immediately. She wants to apply for HSMP now as she is not very happy at work. Her claiming period is Nov06 to Oct 07. In her P60, it states the earning from previous employment as £1000 which is her 2 week's wage paid through a managed payroll company. It was a decision taken by her employer to pay her through that medium. Has she breached any immigration rules?

Please advise.

Thanks Victoria. That is really assuring.

The concern was that she had a work permit for employer A and was paid by employer B in the first two weeks of employment by employer A. Wouldn't it technically be two employers?

No. You have said, this was not an employer, this was a company temporarily used to administer the payroll. With the evidence this should be fine.

That is true Victoria. The managed payroll company was used to pay her 2 weeks wage until HR sorted out her payroll. She worked for the work permit sponsored company but they decided to pay her through a managed payroll company for 2 weeks. My understanding is that the managed payroll company invoiced the work permit sponsorship company for two week's wage so that she could get paid automatically and not wait for 6 weeks. It is a roundabout way of doing things but at that time, her line manager thought that it was the best way forward.
