Hi all !

7 months later no news from the tribunal. I decided to call the number and the case worker told me that it can take up to 12 months before having a hearing date or the hearing date Will be 12 months after the month you first filled your appeal. Meaning that my hearing date might be in August 2016.... So I Will not get my resident card until/around January 2017!

Did someone filled his appeal around march 2015 and got any updates to give us?



Info regarding right to Work :
For those who were granted the right to Work with their COA just so you know you STILL have the right to Work. You need to ask for a New COA every 6 months. I asked for mine and it came 3 days after my request.

I am currently in touch with someone who appealed on April 2015 ... He received a letter On january 2016 confirming that his hearing date is in april 2016...
But if you have any serious reason you believe you need to get your appeal date sooner then you must contact HM Courts and Tribunal Services ....

My husband send a letter on my behalf to ask for a sooner hearing and they didn't reply.... so I think I will just be patient and wait until then.But the strange thing is when you choose the "paper" route they told you that you will get a hearing sooner and a ruling faster.... I think it's a LIE!

i have a problem and need n advice.
I get refusal letter dated 12th of march, but i opened it today as i was on holiday.
Home office saying i did not register with WRS but i did and i sent them my wrs with my current employee name on it dated November 2008 with all the other papers. So now i am confused ... did they miss this ? it was definitely with my application as i just took it out of the envelope home office send me back.
They want £80 for appeal, but why i should pay for somebody mistake ?
Anyway letter says 14 calendar days, so it;s too late ... what now ?
What is the best nr to phone home office please ?

Hi guys
I will share with you my happines and experience. My husband has finally got his residence permit today :lol: :lol: after a long struggle with the Home Office.

Here's our story:

We sent an EEA application 12.04.2015, the Home Office sent us questionarrie 18/09/2015. Me and my husband filled out questionarrie and sent it back after one week. We got refusal letter on our application 29.09.2015. Home Office rejection was very diffuse.

We appeal the decision 10/10/2015 , in the meanwhile I have sent home office more than 7 letters and they answered all my letters. Every time they answered my letters with different reasons, then finally on 29/03/2016 I sent the last letter to the same person how gave us rejection and she or him send us letter with residence card dated 30/03/2016. Since we have sent an appeal we have not heard anything yet, they have not sent us confirmation that they received our complaint, but now we can finally relax. I would advise everyone to not only wait for a appeal , send letters directly to the Home Office and the complainant.

We were refused because they worte in the refusal letter that Regarding to regulation 17 (1) (a) a valid passport: I have explained to Home Office that my husband passport was sent to the Home Office and is still held by the Home office. I submitted a letter with my EEA application from the Home office confirming that my passport is being held by them.


Home Office have been in possession of my husband's passport for three years, they refused to return it. My husband has been overstays for three years too.

They refused to send back the passport, and I refused to give up. I called the Home Office many times, I demand my husband's passport via the Home Office website but they refused to send it back. Finally I wrote a letter to the different Home Office departments in the the UK and reviled out due to the treatment they gave us. After a week so they sent passport to my husband and all identity cards that they have kept for over three years. I discovered that they had sent us an identity card which was valid.

Since January 2016 until now, I have sent many letters of complaint and I asked ask you to look at our case again with new eyes, and I have explained, we are going to win the case in court. Finally so they gave up, and now they have sent us your residence permit

Hi i applied for ror in july 2015 and got refused reason of refusal was x was not working they check on the side as they said in the letter and they right in the letter that they checked HMRC statement. That statement i knows is wrong because i speak to her company where she used to work before sending my application they admit it that she is working with them but they refused to give me any letter data act protection now i dont know where she is gone we dont have any contact i made appeal on april 2016 is any 1 know best sujestion for me please i really need help thank you seniors.

I didn't grt it all but who is your sponsor? Is it a legit relationship or arranged for you to get a resident card?

Thank u very much for help my x was eea national i dont understand legit but as much i understand you mean to ask is my marriage was genuine or not so answer is yes it was but its broke down with divorce please do you know any thing how to find out my ex employer history.

If you got a refusal and now divorced and I think it's better for you to try to re apply as a divorcé Of a EEA NAtional and mention that you want to remain in the UK. I think there is a possibility.

If you filled for an appeal I really hope that you put your divorce papers and a cover letter to ask to remain in the UK even if you are divorced.

I don't really think that the employer will give you anything and you need to ask your ex-wife to provide the documents for you so you can re-apply.

Hi guys!!!!!

Best News every this morning!!!!!!!!!!!!!! I receive the letter with the judgment and the judge allowed my appeal! This means that I Will soon receive my Resident Card. I am so happy !
Thanks to everybody here that was helpful and Kind. My décision was made on paper the 28th Of January official on april 2016 and promulgated the 5th Of May.

Now waiting from HO to send me my resident card and I will update my signature.

The judge also granted a fee reward meaning that I Will get my 80£ back.

My Husband was the most supportive husband on earth, he helped me with all the documents and assisted me during the process. Thanks to him!

If you need me for anything please don't hesitate. If you have questions aswell.
I will update my situation in my signature and Will let you know for the future.

I should have requested appeal by paper only as well, the wait for hearing date just last forever, I still have no news and my husband might change his job soon again ! And may be Brexit will happen as well... Don't know what to to ...

Anyway, did they informed you all the details like checking with your husband's employer etc.?

My only concern at this point is that the HO has 4 weeks to challenge the decision and after that 12 weeks to deliver the RC. We ask in the march letter to get the RC if the appeal is allowed before September because I am expecting and we wanted to go to France and see our families. The judge took note of that on the decision but I am not sure that the HO will take that into account....

So I will wait 1 month I think and write a complaint maybe by email to ask for my passport and RC back ASAP so I can go in France and enjoy my summer holiday.

I have won my appeal on 28/01/16 as my wife was self employed web designer, the judge looked all the invoices, contract and new employment contracts along with self employment and we won the case but on 15 march 16 home apply for to challenge our case again in upper tribunal.


home office is now challenging every case what they losing. but i hope we will win but i have to be ready for one more year wait as our story start on 01/08/2015... wish u good luck

After reading the timeline from start the hearing date generally comes( when it's an oral hearing) around 1 year after you lodged the appeal so I think you'll get a date before the 11/11/2016.... However I don't know if their is any changes since 2014, beginning of 2015......

A lot of people here are in the same case but don't come back to update their situation and it's a bit annoying...

I really hope that you'll get a hearing date soon. I heard about the prices going from 80£ to 490£ and more but the thing is I got my 80£ refunded last week so I really hope that even if they do increase the price it will be refunded.... not in every case I think but in most of them!!!!
