EEA unmarried partner w/ EEA child below 2 yrs. cohabitation

Post by tonifly » Wed Sep 28, 2016 7:21 pm

Hi!

I would like to ask for some advice regarding my case. I am looking at applying for an EEA family permit as an unmarrried partner of an EU national who is a qualified person (but still under maternity leave). My partner has given birth to our (EEA) child early this year and we are currently living together in the Philippines short of the 2 year requirement. I have read that our case can be considered under compassionate circumstances since we have a child. Also we do not have much proof of cohabitation since we have been living at my condominium unit (under my name) so we do not have tenancy agreements. We can only submit a certificate that states that she lives here with me. Unfortunately her name on the internet and cable bills at our current address have been misspelled (only one letter).

My question is, Do we have a chance at getting approved with very minimal documents to prove cohabitation?

Also I have read that for EEA family permit applications, the financial status of the couple should not have bearing on the result of the application. However I do have enough savings (more than 16,000 GBP which is required under UK immigration law as far as I know) to prove to them that we will not be a burden and resort to public funds for survival.

Would it help my application if I submitted bank certificates, or would this be completely unnecessary?

Hope to get some useful advise :) Thanks!

How is partner a qualified person at the moment if you have lived some portion of time in Philippines?
It sounds like your application is more of a move than a join-type of application.

With minimal documentation you have minimal chance even if you overcome the 2 year time limit due to having a child.
Its quite common to face refusal and have to reapply.

Follow the FP guide here:
https://www.gov.uk/government/uploads/s ... permit.pdf

Suggest engineer your life to generate more of a papertrail.
Put partner on cable and/or utility bill and residence association membership.
Get some sort of certification or affidavit from Barangay Captain and/or NSWD & etc.

She went to UK while she was pregnant and worked there during her 4 month stay. She came back here to give birth, but she wants to go back there soon and stay for good. She still has her job.

Thank you for your feedback. :) I will just do my best to gather as much evidence as I could, she's planning to leave on December.

So the FP is for you.

You still need to plan for possibility of refusal; the more so the more you are below 2 years cohabitation.
