need help visa refused

my solicitor received a refusal letter yesterday, I need advice on if I have hope if I go for AR,Zimba88 your input and advice are much valued
Reasons for refusal: creation of jobs
you have provided: "passport copies, biometric copies, wage slips, RTI for april 2016 to dec 2016,P60s
.....although you have provided detailed evidence of RTI from April 2016 to Dec 2016 we cannot accept hours for either employees from before April 2016 as the RTI you have submitted between Nov 2015 to March 2016 do not show individual monthly HMRC payment, therefore we can only calculate a total of 1170 for employee A and the same for employe B a total of 2340 hrs ... "
My solicitor and my accountant both insist that this is a mistake on the case worker side and that AR can overturn the refusal. RTI was submitted along with my application starting NOV 2015 and the company paid HMRC monthly.I have looked through the forum for any similar case but it does seem that I am on my own

Can you post here copy of Pre and post April 2016 to see what was the difference in between them . If you had all the info on all fps as required for claiming points you might have chances in AR .

I did make NI payment monthly for each of the 2 employee, my accountant says it is the FPS report that was quaterly but the payments were monthly. I am sure the payments were monthly, I am totally confused. Both my accountant and solicitor seem to be sure that AR will reverse the refusal. I honestly am confused, my solicitor says it is a ridiculous decision, my accountant says he has never heard of anything like this before!! I simply dont know. Which software your account use. MY fps is for each month. Every month, account need submit to HMRC and then have a fps submission confirmation and the fps report.

I have looked it again, no prior to april 2016 it is a very strange format, it shows the start date for employees and runs all the way to 5/4/ 2016 it shoes gross earning, shows total NI paid for the 5 months, also empeecontributions for the 5 months

yes it is, i pay 1000 per month the submission report says start date 1/11/2015 end date 5/4/2016, it clearly shows the gross earning for each employee, total NI ...etc,

I have had the same accountant since I started and I really dont know how to insert an example of the different submissions, one is just the normal format month by month and the order is like three sheets of paper for each employee, the weird thing is that I employed another staff member nov 2016 who has completely been disregarded (no hrs calculated for him)

130 hrs at min wage is below £1500..... (but not two employees unless apprentices)

Again, They accepted some of your FPS and declined others. Unless you make it clear what is the differnce (suggest via scan and remove the private details) YOU WON'T get a response that actually helps you
