Application FLR(FP) - Appeal Accepted

Post by hussainmehboob » Wed Jun 28, 2017 5:36 pm

Hello,

I am new on this forum and hoping someone can advise me on the following;

Made FLR (FP) application and initially got refused by the home office but got appeal rights. Went into the court got my date for 11th of May and the decision came in on 07/06/2016 and was made successful (HomeOffice had 14 days to challenge the decision into higher court). The very next day i got a letter from the Enforcement Office saying i need to report them once in a month and first reporting was on Wednesday 14th June 2017. I went there with my appeal decision and they cancelled my reporting as their system was saying i have already been granted 30months of leave. They also mentioned that i will receive a letter from the case worker.

I am just curious if they given me the right information as i haven't received anything yet from the Home Office. Does anyone know how long it usually takes in this kind of situation.

Many Thanks

I will really appreciate if you could share your experience. I made flr fp application in may 2016 and got right of appeal. my appeal is in oct 2017.
Could you please let me know what refusal did home office put against you and how did you defend them in FTT.

I am married to british citizen, also i will inhsAllah becoming father (1 week after the hearing date).
I need to show that there are insurmountable obstacle for my wife to relocate to pakistan
Please reply as it could prove helpful for me. Thanks

and to answer you question about getting visa. I won my first appeal in 2012. Got judge's decision after 2 weeks of hearing. Home office did not challenge the decision on 14 days and ultimately they issued me visa after 3 months of getting judge's decision. In other words, i won the appeal in august 2012 and got my brp in nov 2012. they refused me again in may 2016 with right of appeal which is non sense

Wasalaam Bro,

My wife is a born british citizen and homeoffice refused my case that i should return back to my country and should apply for a spouse visa. Allhamdulilah, i had a very good lawyer who prepared my appeal and gave some strong insurmountable obstacles for my wife that she can't just get up and leave the country.

Salam brother, i think since you are a new member to this forum, you wont have access to private msgs. Also Moderator said we cant put our private contact info here. Is it possible if you could give a general suggestion on how to go about insurmountable obstacles in court. please see my points in previous comments.

Thanks

Wasalaam,

Yeah, i don't have access to private messages. Sorry i won't be able to provide you with full details here but yeah, I had some strong points in my appeal and one of the point we stressed was with my wife's failed pregnancy, she had a recent miscarriage and how she's traumatised with the situation and how she can't just move to a country she doesn't belong. We also stressed on a argument how its a male dominated society and my wife being a professional chartered accountant won't be able to continue her career if she's asked to move along with me.

Also, my wife has got some upcoming hospital appointments to further assess her situation with failed pregnancy and her GP wrote a detailed letter about her situation and how distressed she can be if her husband has to leave United Kingdom even on a temporary basis.

If you look into FCO website https://www.gov.uk/guidance/reduce-your ... ile-abroad
explains the risk for a british citizen to travel, you can use this reference and provide other details by referring to news articles.

Congratulations on your visa following a successful appeal. Would you mind sharing your court case? It is going to be useful for me and perhaps a few other members. Our claim was a bit similar. Thank you.

Thanks for your reply. I was actually wondering if you had a court case number so it could be cited in another appeal. As I said, our claim is similar and your case may be a reference for me and few other members.

Hi Brother,
Thank you very much for the writing which helped me get insight of your as my case is similar where i get Refused on FLR FP with an appeal right which is due 28th August 2018.
The reason for the refusal was they want us to relocate in bangladesh even though my wife is a british national, The HO stated that we do not have any insurmountable circumstance to reside in the UK.

Brother i am stressing too much in upcoming due date of my hearing. Your valuable advice on what insurmountable circumstances are generally accepted?
