Set(P) refused - pls help

Post by katiron » Fri Sep 01, 2017 4:29 pm

hi all i i hope everybody is alright
i just had a very sad news today as my application for ILR been rejected
the application been made in 29/03/2017
i received emails every month
1st September received letter said that the application been rejected. I will copy the all letter and i need your help and advice.

dear.....
thank you for application fro settlement( protection route) dated 29/03/2017
form set(P) application are for anyone who has been granted 5 years refugee leave and is now applying for settlement in accordance with the published home office asylum instruction on refugee leave. it is also for anyone who has been granted 5 years limited leave to entry or remain on grounds of humanitarian protection, since august 2005.
your application has been rejected as our record indicate that you have never been granted a period of leave in either of the categories stated above.
application forms for leave to remain are only available from our website at www.ukba.homeoffice.gov.uk. should you want to make a fresh application you will need to complete the form/s for the relevant PBS category. advice can you also be sought from the immigration enquiry bureau on 03001232241.

i came to the UK as family reunion (in March 2014) as my husband granted refugee status. but we separated in year time and now i live with my British partner because my visa expired in same time with my ex husband and then i applied for ILR.

could anyone explain to me the letter which been sent from home office and whats solution to apply or get any other advices.

thank you everyone

What is your full UK immigration and full details of visas (what it says exactly on your visa)?

When did you divorce?

Does it say which category of leave to remain, i.e spouse visa etc?

Can you remember what form you filled in for leave to remain (FLR M etc) and was your visa issued for a full 5 years or have you applied for an extension at any point (2 x 2.5 year visas)?

How long have you been married?

Did your relationship start before he was granted refugee status in 2012 or did it start after this date?

Did your husband apply for ILR separately to you?

For you to qualify, you have to be in a genuine and subsisting relationship with your husand, which you clearly are not, and apply together (as far as I understand).

How long have you been separated from your husband?

I don't think you qualify for ILR then as a family member of a refugee. You separated from your husban a month after getting a visa based on his status.

How long have you been with your British partner?

You should have applied to change your visa based on your British parntner.

You should now try to apply for FLR(FP) 10 year partner route.

If you are not, and have not been since you got your visa, in a geniune and subsisting marriage (with evidence to prove it, i.e. living together and joint bills), then ILR will fail.

FLR(FP) Partner route is a 10 year route to ILR (4 x 2.5 year visas) before you will qualify for ILR. It is likely the only option you have now.

Were you born in Kuwait?

What did you submit for a entry clearanc visa (passport or similar)?

Your flag that you have chosen for your profile is for Barbados in the Carribean, hence the confusion.
