by getting your country passport you availed yourself to you country's protection and this is bad news!
1-can you prove that you have been given a wrong advice by ur case worker? i.e., emails, letters etc
2-can you prove that you have NOT been to your country of origin on your passport? i.e., do you have a tourist visa to UAE endorsed on your country of origin passport? if you have not this will indicate that you may have only used dubai as transit passanger
3-could you explain, not for us obviously, how you re-entered through UK borders on your way back from dubai? did you only have your refugee Residency card and was it ok to produce that with your country of origin passport? this is a very interesting case!

Hi, I do not have anything to prove that I had been given a wrong advise as that case worker had convinced me only verbally. UAE don’t necessarily issue you visa on your passport but I do have visa copies both times. My passport did have the entry and exit stamps from Dubai and because I only went to dubai, it has only dubai’s Stamp. Both times when I came back I had to present my residence permit and I wasn’t even asked a single question at the Uk airport.if I had been stopped once I wouldn’t have done this again. I only realised my mistake when I was reading an article again I was issued the travel document without any questions. So now I’m confused. When I spoke to my lawyer who I hired for my ILR, he thinks my case is different as I was a victim of domestic violence and not political asylum

Also entry stamp had been put on my passport both times when I entered UK.

I think you have a case, and it is actually different. it seems to me that you dont need to worry much! if they get back to u questioning the matter i guess you should just explain this, and it definitely helps that you have dubai's entry and exit stamps which demonstrate that you have actually been there for the duration . best of luck

Thank you and let’s see will keep you updated if they raise any questions. I just don’t understand why they never stopped me when I was entering in the UK back from Dubai both times, and after sending them my valid country of origin’s national passport, and apying for a travel document, that was issued to me straight away. :roll:

Fingers crossed .... however i think u will most probably get it in next week mine is 50/50, ideally i think i will get mines by 15th Feb.

Hi, I have just found out about this forum and I need some legal advice. I have a refugee status with residence permit card for 5 years in the UK and still have my national passport. I did not know that I can not use my passport before, and I applied to get a Canadian visa on it which I was granted. I don't know what will happen to me if I used my passport only for one time with my family who are all in the same situation. I don't want to be to rescue my residence here but if it is OK to travel I will go ahead with the plan.

Did you get your passport renewed or what? I was retuned my still valid national passport when I was granted refugee leave to remain, and after it expired i got it renewed after a case worker told me that I can and I should as long as I don’t travel to my country of origin. I not only got it renewed but travelled on it as well. The mysterious part is that nobody questioned me ever until I realised this mistake myself and retuned the passport to Home office. I would advice you to not to risk your residency in uk for the sake of a visit to Canada. Seek proper legal advice. As a refugee you should only travel on a travel document

This will usually indicate voluntary re-availment and may lead to revocation under Paragraph

If someone who has been granted asylum applies for or travels with a passport issued by a country from which they have previously sought asylum, it could be considered that they are re-availing themselves of protection by that country. :idea:

Hi Saniii, yes I still have my national passport which is still valid. I didn't travel with it after I got the refugee status. Will the visa stamp on it affect my ILR application later on?

Do you think the visa stamp will end up in refusing my ILR after I finish the 5 year residency?
When I reach that stage my national passport will be expired

I mean a visa was issued on one page of my passport. As I mentioned before, I didn't know that I can't use my national passport and therefore I applied for a Canadian visa in London which I was granted on my national passport. I didn't travel with my passport.

Hi I can try and help - please do your own research too

1- the letter / email you get from HO is one that you can work and live in the UK. Any employer should know this.

2- as per point 1 above , you status in the UK remains ‘as is’ until your application has been decided - so if you were allowed to work, then you will be able to continue to work until decision is made and same goes for HB CN etc

3- the key is in the name! Indefinite Leave To Remain ILR so has no limit but it has a date one it for a renewal mine had 10 years on it but then never needed it as applied for Natrulisaion shortly after ILR so it didn’t matter anymore

4- that usually the plan! After 1 year of the decision of your ILR you can apply for natrulisation and then become British - therefore ILR becomes irrelevant
