HI AM29, i applied for partner route in 2014 it was refused because we had no insurmountable obstacles. which I must say is a very hard test to prove for the home office even though I had a lot of proof. I was given an in country appeal in 2015 and was dismissed and all rights exhausted. I was asked to go back home to do an entry clearance but I was advised not go and do it because the HO can be funny. at this point i spent so much money with lawyers and gave up. However, i was requested an IS26 after refusal in March 2016 i went to croydon and the day i went there i was being detained and put on a flight to my home country DING..... at that point God took the wheel I was 8 weeks pregnant and i informed the officer and was told to seat and wait for an interview. i was told because of being pregnant i wasn't going to be detained and my flight was cancelled and was asked to seek legal help. i read few comments on this board and i didn't make any application until i gave birth as it was going to be waste of money. i was actually lucky the immigration officer i met that day told me the same and told me to make my own application once I had a baby. I gave birth in 2016 Nov and made my application July 2017. I did my Biometric in August 2017. was requested for more documents on the 12th August 18 to be received by 30th August 18. more docs sent 28th August 18 , tracked my parcel and it was received 29th August 18. Today i received my BRP no documents or passport yet. i made my own application with help of immigration law text books in Library based on British partner and British child. i can also provide a thread with the list of documents i sent including information to support application such as my cover letter, personal statements.

the wait is such a killer , but i have a great partner, family and my super toddler kept me going. I completely forgot about it. but social media makes you think you are missing out. but not until you realise not all of it is realistic ...
Big Congrats to you. you have been on a journey.

Thanks PrettyPoppy - my husband has said to anyone, anyone who is planning to overstay or wants to overstay: don't. It's a miserable life and a struggle. We realise how precious life is..2 years of my own life consumed with this board, HO, twitter, MP and research. It was 11 of his. God bless everyone on a journey

Hi when I applied i already had a provisional driving license. thats the ID you need a provisional . i have been in the country from 2000 i was on a student visa which expired in 2012. so was an overstayer but i had applied for a provisional when i was a student and had a valid passport. you do need a passport in that case they is no other way out.

Does anyone know the answer to the following question.
"Is an overstayer allowed to use the NHS once they have paid the IHS fee as part of their application for leave to remain, can they use it while their application is pending or can they only use it when granted leave to remain?"
If anyone knows the answer it would be a great help! Thanks.
No, you cannot however if you have an accident (A&E) then NHS will treat you, it's the normal procedure weather you have paid or not.

I applied in April 2017 acknowledgement and biometric in May 2017 after that nothing at all.on 16 July 2018 asked for additional documents which was sent on 30 July 2018 waiting since then nearly 2 weeks but we can only hope my friends.
Did they ask you to prove the residence of the child is same or not and to prove that parents are listed as emergency contact in school and gp.
Yes they asked us to send the bills or gp documents on the same address and also the proof of the child living at the same address letters from gp and school etc and specifically from April 2017 since I send the application.
okay, so we could get the same decision hopefully good. As i never heard that they ask for additional document in 7 year cases,. they just simply refuse or allow.
Hi,
I send same application on December 2017 and today I received that they need more documents related children like gp, schools letter etc... Can you tell me that what response you get now?

I did create my own post but did not get much response to it so i am posting here the same.
I need advice from respected members of this group.
We have applied in Oct 17 as a family on the basis of our child who turned 7 in sep 17. We have our biometric in following month. In feb 18 Home office sent two forms back with missing signature which we have signed and sent back within a week. Since then we have not heard anything from Home office. We have contacted our local MP four weeks ago who requested home office to provide the reason of delay and prompt action on the case. Home office did not reply to MP yet. But my Solicitor received a letter from home office on 7th Aug to provide the proof of residence of the child to confirm that we are living with child on the same address and they did say in the letter that they are aiming to take prompt action on the case once the information is provided. We have sent letter from gp, school reports and utility bills yesterday by recorded delivery.
I just want to ask if is it a positive attitude of home office that they taking long and asked for this kind of information. Or they are just delaying purposely and going to refuse. Thanks in advance
Hi sky,

Hello, I'm in a similar situation to yours. I made the same type of application (FLR FP) as yours at about the same time as yours as well. I also just received a letter from the Home Office requesting further proof that my child lives with me in order for them to make a prompt decision on my application. This is despite sending all such documents with the original application. Nonetheless I have sent the requested documents. Do let me know if you receive any further correspondence from the Home Office on this issue.
From the comments I've seen, it seems to be a positive sign.

When did you get the letter and sent the documents??? Yeah i will keep updated when i get the reply. There is one more person in this forum who is in similar situation and he sent documents on 30th july.
Was your kid born here??
How old was the kid when you applied?
What did Home office say in refusal???
Sorry if I sound too anxious. I could not get that how Home Office without right of appeal. Too worried.

Hi arham208, it looks like georgicha have not met the criteria when he applied as it is like impossible get no appeal in 7 year cases. Let’s wait for his comment for clear view of the situation.
