Do I need to change to citizenship dependent if i already have an ILR dependent?

Post by Pm30 » Thu Feb 28, 2019 1:04 pm

Hi my husband currently has an ILR and i have an ILR dependent. I am due for applying for my ILR in june. My husband is due for his citizenship is march. If he gets his citizenship in march do I need to again change my visa from ILR dependent to citizenship dependent that time in march?

There is no thing like “ILR dependent”. What is your visa cetegory atm? Are you a PBS dependent?

What was your husbands visa category before he got ILR?

Hi mine is PBS dependent and my husband currently has ILR. Before that he had Tier 2 work permit for 5 years. I am also due for ILR in june. But my husband is going to apply for his citizenship in march. I just wanted to know if he gets his citizenship in march do I have to again change my PBS dependent visa?

Just complete your 5 years on PBS dependent route. Do NOT change your route otherwise your ILR clock will set to zero.

What date did you get your initial Tier 2 dependent visa?

What is your current Tier 2 dependent visa expiry?

Did your husband get ILR on 5 years on Tier 2 basis or Long Residence base?

No you just carry on your PBS dependent visa. Dont change the route as your ILR clock will set to zero and you will need another 5 years to qualify for ILR.

You are eligible to apply for ILR on SET(O) from 5th anniversary minus 28 days from your initial visa date. So you will be eligible to apply in June 2019, regardless if your husband becomes a BC.

Apply your ILR in June. Once you get your ILR and once your husband becomes a BC, you dont have to wait 12 months on your ILR to apply for your BC. You can apply for your BC as soon after your husband gets BC.

I was under the impression that since my husband's immigration status changes from ILR to ritish citizenship I would need to extend my PBS dependent accordingly.

Also, since your husband already has ILR, if you want you may opt for super priorty service (24 hours) for your ILR at £610 additional cost. You will get quick decision.
