Confusion regarding start date on Set O ILR

Hi again,

I have a new problem, and hope Tier11417 or anyone here can help me.

I have submitted my ILR through Super Priority service 5 days ago, and today i received an email from the UK Visa that my application is under consideration.

As I quote the email, “ on our record, you have been granted the last leave to remain including your four children”.

The thing I have never applied for ILR before, I have only applied for the BRP for my kids, wife and me in 2016.
Their records show leave to remain that is your current visa NOT ILR. Its a standard protocol for children safety for them to ask why you have not applied for their ILR as yours. Relax


And the letter continues , “ As the Home Office is dedicated to protecting the safeguard and interests of these children, we therefore would ask that you now confirm the whereabouts of these children and provide a reason for why we have not received an application for them.”


I didn’t include everyone in the application as Super Priority service is costly. I will apply for my family after I was granted PR. Its not called PR its ILR

So what should I do now? From my understanding, I would have to submit proof that they are still living with me and that I will apply for them as soon as my PR is granted.

The other problem is my wife and my kids’ BRP will expire next week 13 April 2019.

Should i proceed and submit the ILR application for them anyway before getting a reply from UK Visa? (Was planning to submit it today or latest tomorrow, I was just waiting for the confirmation of my PR to arrive).

Any inputs/suggestions are very much appreciated.

Its a generic email asking about your dependents. Just reply stating that you will apply for your dependents before their expiry via standard service and register your Uk born children as British Citizens after your ILR is sorted. I think they did not go through your cover letter. This is a standard protocol email. Just reply as above. Make sure you apply for your dependents before 13th regardless if you get your decision or not. Once you reply the email your decision should be quick.
You can wait and apply for them on 12th April(before expiry). I am hopeful you will get a decision this week after you reply to the email.

I’m replying to their email as we speak. I really want to just proceed with my wife and sons’ applications ASAP, but I will wait maybe until Wednesday for UKVisa’s response. If there’s no response from them, I will submit the application on Wednesday - which is 3 days before their BRPs will expire.

Can’t sleep thinking about this. Am really hoping they will response quickly ( which is tomorrow) after I send them the reply.

Thank you for clarifying that. I was thinking about that too in the beginning , since they just mentioned “leave to remain” and not “indefinite” leave to remain but just not too sure.
