PBS Dependent which form to Use

Post by Trishanj » Sat Jun 06, 2020 8:44 pm

Hi,

Apologise if I am asking the repeat Question on similar Topic, but I am Bit Confused on this.

My husband got ILR on 10 Year Long Residence Route in October 2018.

I Came in UK on PSW Dependent in July 2013
Got an Extension as PBS Dependent in June 2014 to July 2017
again got another Extension on PBS dependent in July 2017 to June 2020.

Which category should I apply?

many thanks in advance.

You have to switch visas to FLR M spouse visa and meet the English A1 minimum and financial requirement of £18,600pa, it is more if you have non British children.

This resets your 5 year ilr clock.

Many thanks for advice,
Can't I apply for ILR even if I have completed my 5 years as PBS dependent from June 2014 to June 2020?

the requirement of £18,600pa is it from me or my Husband?? as I am her dependent? do I need to show any financial statement of 90 consecutive days?

No you can't, the rules don't permit it because your spouse got ilr based on long residence and not through PBS 5 year route. The rules about this changed in April 2014, link below, so it isn't anything new.

Either.

There is NO 90 days maintenance fund requirements for FLR M spouse visa. The 90 days maintenance funds is only for PBS routes.

FLR m you have to meet the annual salary rrquiremnt. With a minimum of 6 to 12 months evidence of payslips and bank statements and employer letter, also documents depend how you or your spouse are employed and plan to meet the financial requirment. For example, self employed is a lot more evidence.

Liuk is not required for a spouse visa.

English B1 is fine though.

hi,

really sorry for a silly question which is bit tricky.

Is your current entry clearance or leave to remain as the partner of one of the following?
a British citizen
a person settled in the UK
a person with refugee leave or a person with humanitarian protection in the UK
(Required)

If Yes, what needs to be done on the below question??

Were you originally granted leave on the basis of an application made before 9 July 2012 as a partner on the family route?
(Required)
Your original leave to remain would have been for 2 years. You cannot have had an application considered, granted or refused on another route since that time.
