*REFEREES INQUIRY*
I am posting in this thread as I didn’t want to open a new one for a possibly the same question which had been posted already.

I’m planning to apply for a British citizenship and I’d like to confirm whether my referees are suitable for the application. One of them is a director of engineering with BEng (HONS) AMIMechE another one is a director of a company (I’m assuming a vat registered one) as he runs a car dealership business.
On the professional standing list there’s one for “Engineer (with professional
qualifications)” and “ Director/Manager/Personnel
Officer of a VAT registered Company”. Of course I’m going to ask one of them to act as my professional referee.
Would they qualify for that?
Thanks.
These are suitable if they satisfy all the requirements for referees.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Hi,

i have both a permanent residence card and an eu settlement scheme. When filling in the british citizenship form, which one should i put under:

what will you use to apply for a British Citizenship?

Permanent residence card or indefinite leave to remain

I'm asking this because i believe the permanent residence card will expire on the 31st of December, and i'm planning to send my application off in January
Presumably you mean Settled Status - if you have held it for 12 months you can use that.
oh yes! sorry that's what i meant.
thank you

this might be a stupid question but : do you think it's ok to send off the british citizenship form off right now considering the country is in lockdown and things may not be functioning as normal (processing time etc) or should i wait a couple of months until things look a bit better ?

Hi,

I am applying under EU settled status (granted in Sep 19). I had some questions regarding the form:

Are you either:

An EEA national who has been issued with a permanent residence document
A family member of an EEA national who has been issued with a permanent residence card
-> I should reply yes?

What will you use to apply for British citizenship? -> I should select Indefinite leave to remain (ILR), including ILR granted under the EU Settlement Scheme ?

Are you able to provide a biometric residence permit (BRP) card with this application?
-> I guess this doesn't apply to me?

Tax office reference number -> I found it on my p60. However should it be the full reference or only the first three digits before the slash?

Regarding the documents to provide:

What's the difference between

Evidence that you have been in the UK lawfully for your 3 or 5 year qualifying residence period. This should be evidence that you were here as a worker, student, self-employed, self-sufficient, retired or incapacitated person

and

Proof of living in the UK for xxxx for 5 years if applying in your own right or 3 years if applying as the spouse of a British Citizen

If you are married to, or in a civil partnership with, a British citizen, you must have been in the UK for the past 3 years.

If you are not married, or in a civil partnership with, a British citizen, you must have been in the UK for the past 5 years.

If you are an EEA National, you need to include letters from employers, educational establishments or other government departments, indicating your presence in the UK during the relevant 3- or 5-year period.

as both are required.

xxxxx's proof of Nationality
You must include your:

passport or EEA national identity card
UK permanent residence card
evidence of freedom from immigration time restrictions

You must have a permanent residence card before you can apply for citizenship Apply for a permanent residence card.
-> I do not hold a UK permanent residence card as I'm applying under EUSS. Would it be an issue?

If you spent some of that time in the UK as a student or as a self-sufficient person, and had comprehensive sickness insurance (CSI), a copy of your sickness insurance policy -> I was a student for half of the time of my residency. Would a proof of a private insurance held in France covering me in EU be enough (in french)?

Cheers

Hello.

Need some advice on naturalization too.
I'm an EEA family member.
BRP granted in 2017
Settled Status granted in August 2020.
In the UK since 2011
I basically got permanent residence status way before settled status.

Reading this: https://www.gov.uk/british-citizenship
From 1 January 2021, if you have settled status you must apply for citizenship on that basis. You cannot apply with permanent residence status.
and
Example
You came to the UK in 2013 and gained permanent residence status in 2018. In 2020, you applied for settled status.

Usually, you would need to wait 12 months after getting settled status to apply for citizenship - but because you had permanent residence for 2 years, you can apply straight away.
Am I understand it correctly, that if I decide to apply for naturalisation, I do not need to wait till August 2021?

In the application form, there are two options
What will you use to apply for British citizenship?
1. Permanent residence card or document
2. Indefinite leave to remain (ILR), including ILR granted under the EU Settlement Scheme
  1. date of settled status granted
To my understanding option 2 is correct in such case, but how to provide information about BRP and free from 12-month qualifying period time restriction?

The answer should be simple, I believe:
1. Are you married/civil partner of a British citizen? If yes, and assuming you have "full" settled status, you can apply now.
2. You can apply using either your PR card (to apply now) or Settled Status (to apply in August 21 if not married) - Note that PR cards can be used for naturalisation until 30 June 2021.
If I have missed something please come back and post here.

Thanks for reply.
My partner is from EU, not UK citizen.
This is a whole section(https://www.gov.uk/british-citizenship):
If you had permanent residence status before you got settled status
From 1 January 2021, if you had permanent residence status before you got settled status, you can count that time towards the 12 month qualifying period.

Example
You came to the UK in 2013 and gained permanent residence status in 2018. In 2020, you applied for settled status.

Usually, you would need to wait 12 months after getting settled status to apply for citizenship - but because you had permanent residence for 2 years, you can apply straightaway.

You do not need a permanent residence document to apply with settled status.
and
Permanent residence status and citizenship from 1 January 2021
From 1 January 2021, you can only apply for British citizenship with permanent residence status if:

you already have a permanent residence document
you do not also have settled status under the EU Settlement Scheme
You cannot apply for a permanent residence document after 31 December 2020.

If you have settled status, you must apply for citizenship with this status instead of permanent residence status. Do not apply for citizenship with your permanent residence status if you have settled status. If you do, your application will be rejected.

You can apply for citizenship with settled status 12 months after you first got permanent residence status. You do not need a permanent residence document.
There is nothing about partner immigration status. From examples, it seems like there is no need to wait for 12 months after settled status since the first permanent resident status was granted 2 years ago.

My situation is very similar to the example. e.g. PR in 2017 and Settled status in 2020 e.g.
but because you had permanent residence for 2 years, you can apply straightaway.
Is my assumption correct or I'm totally wrong?

Do you have a Permanent Residence Card (assuming that you are non-EEA citizen) or DCPR (if you are an EEA citizen)? If yes, when was it issued?

As for the EEA partner, are you married to the EEA partner, in a civil partnership with them or in a durable relationship with them?

I think the whole section in regards naturalisation was recently updated, as I have not seen or probably missed some of the explanations.
Anon (2020) Page 21. Guide AN Naturalisation Booklet The Requirements, [Online]. Available at https://assets.publishing.service.gov.u ... ber_20.pdf (Accessed 10 January 2021).
Do you already hold EUSS leave (either settled or presettled status)?
Yes
You must use EUSS ILR to show that, at the date of application, you are free from immigration time restrictions. Do you also need to show that you have been free from immigration time restrictions for at least 12 months?
Yes
If you have not held EUSS ILR for 12 months, then you can also cite an earlier date when you acquired Permanent Residence where this helps. You do not have to provide a Permanent Residence document, but can do if one is held. This may also help to show you have been residing here lawfully during your residential period.

Hi Guys, Quick MN1 question. From the timelines thread, it seems the applicants are not getting the approval eMail. Would you know if the approval eMails are reliable for MN1 and AN approvals? Asking because I had issues with our BRP delivery to our solicitor by TNT and the eMail will help keep an eye out.

Hi

I'm a Non-EEA family member (my husband is EEA), I've had my settled status since June 2020.

There is a question in the AN application form:

Are you either:
An EEA national who has been issued with a permanent residence document
A family member of an EEA national who has been issued with a permanent residence card

Do I reply 'no' to the above? I understand that a permanent residence card is a different document from settled status (my settled status card is called 'permanent residence' though..). I'm confused, please help:)

Thank you.

Correct - answer "no" to both - that is a left over from EEA regulations ....

Your UK Travel Document with any stamps in/out will be sufficient - presumably you don't have a passport.

I have been in the UK for 12 years. I hold ILR since 2011 after family reunion visa. I applied for BC in 2014 I got rejected and banned but now HO says it was a mistake and can apply. I hold BRP now and work full time professionally for 6 years. My issue is my passport expired years ago and never renewed it. I don’t have travel document. Do I need to submit the expired passport and will it cause any problems? It is very difficult for me to renew the passport. Or my BRP+driving licence+P60 should suffice? Thanks in advance.

Hello,

I wonder if you could help me with below points of online application for citizenship by naturalisation

I am Polish and have lived, studied and worked in UK since 2006, I haven't applied for permanent residence until Brexit was announced, which means I applied for settlement status in 2019 and I have received it as settled status.

I did my settlement application via smartphone app and wasn't asked to provide with proof of english knowledge (I have a bachelor degree in UK) or BRP. I had my passport scaned and picture taken via app, that's all. Does this count as BRP?

1. English Language.

"Do you have a previous visa, entry clearance or leave to remain where you had to prove your knowledge of English"

I answered No as they didnt ask me to provide this info for settled status - is that correct?

" Did you meet the knowledge of English requirement as part of an indefinite leave application made on or after 28 October 2013?"

Should I answer no because i wasnt asked to provide any proof?

2. Biometrics -

"Are you able to provide a biometric residence permit (BRP) card with this application?" I answered

" No I do not have a BRP for my most recent leave"- is this correct?

"Do you have a BRP from a previous stay in the UK?" I guess again no?

3. UKVCAS does it direct me to book this service after I submit and pay for my application?

Many thanks for your help in advance, these things are so mind boggling :)

2. Biometrics -

" No I do not have a BRP for my most recent leave"- is this correct? Correct - as above.

3. UKVCAS does it direct me to book this service after I submit and pay for my application? No - after submit you will be able to online book an appointment from the calender slots displayed.

*Referees enquiry*

The guidance asks for a professional referee who is a director of a limited company. My manager at my Limited company (listed on LSE) has the title of Vice President and is willing to give a reference. Is this ok for the professional reference or is the designation of director something that is absolutely required. He is a British citizen and has known me for 10 years

I always thought a vice-president of a company is a director.

But in legal and accounting terms director would be one who is listed as a director with companies house or in some government records. Other designations like VP could vary by company and not be listed in companies house or elsewhere in government records nor have any legal/fiscal responsibilities. For instance I’m an AVP in my company but really am not responsible for the accounts nor do I have signing authority on any legal documents
