PBS Dependant - Further Leave To Remain w/o resetting clock

Post by thevar » Fri Sep 02, 2022 10:37 am

Hello everyone,

My spouse is on a Skilled Worker Visa valid until Jan 2023. However, having completed 5 years last month (in August 2022), she now has an active ILR application under process.

I am on PBS dependant visa (dependant on my wife's) issued in March 2020 and valid until end-Sept 2022. I am now seeking to extend my stay in the UK as PBS dependant (not ILR dependant since I don't want my PBS dependant clock to be reset). On my application, when I go on to pay my IHS fees, it asks me to pay only £312 (which is only up until my wife's Skilled Worker Visa duration of Jan 2023 - and that is fair). However, I want my visa to be up at least until March 2025 (on the belief that my wife's ILR application is indeed straightforward) which is when I will complete 5 years and thus be eligible for ILR.

Now my doubts are
1. Am I doing anything or is my understanding of the situation wrong?
2. Assuming my spouse's ILR is successful, does the above scenario mean I have to apply again for Further Leave to Remain in Jan 2023?
3. What should be my best approach in the this case of mine?

Looking forward to your help. I am really nervous about this situation

A PBS Dependent extension is granted for 3 years. For the IHS, you need to put a date 3 years ahead from the date of application for your extension.
1. Am I doing anything or is my understanding of the situation wrong?
IHS is payable for 3 years.
2. Assuming my spouse's ILR is successful, does the above scenario mean I have to apply again for Further Leave to Remain in Jan 2023?
No, you apply now and your application will only be considered once the ILR has been granted.
3. What should be my best approach in the this case of mine?
See above.

Thanks CR001 for your reply. When you say "For the IHS, you need to put a date 3 years ahead from the date of application for your extension", what exactly do I need to do and where?

Wherever on the form it asks about spouse work end date, put a date three years in the future.

Note that we don't have sight of all the online forms and questions!

CR001 - So I have inputted as you have advised, but there is a field which asks about my Skilled Work Visa expiry date which is in Jan 2023. I think that is what is causing the IHS payment to be taken only until that period. What do I do now?

Spouse visa expiry is in Jan 2023. Do you mean I wrongly state it as Jan 2025?

This question is ONLY for calculating the IHS. If you submit and pay today, put a date 3 years from TODAY!
