Apply ILR with bankruptcy

Post by marychan8989 » Thu Dec 14, 2023 9:41 am

Hi all.
I am due to apply for ILR in 2027. I was currently with bankruptcy overseas and I never go back to the country to deal with it.
Will HO check with my overseas finance? Or should I go back to that country to deal with it? I am unemployed now and it requires 4 years to remove my name from the register.
I am so stressful now and afraid of the ILR refusal especially being forced to be separated with me two babies born in UK.

Can anyone advice me please? Thank you so much.

Debt is mostly a civil issue and on its own should not have any effect in the UK unless for example you have built up a large debt and have not worked out a repayment plan. I doubt UKVI has much interest in these civil issues, particularly outside the UK. Your ILR is more than two years away, so the rules may be different by then.

Thank you for your reply.
I also doubt UKVI have much interest in overseas issues. I do not have any debts in UK and have good credit score. So I think I must maintain good financial background in UK.

I just wonder if UKVI has the system checking overseas finance for each application? Or UKVI just checks it for any suspicious application? If I declare overseas bankruptcy at the application, I am sure I do not have any supporting documents as I never go back to that country. Any advice please?

Not sure what visa type you have now, but widely speaking no need of any overseas financial documents to apply for ILR.

The advice here is to stop worrying about something that will happen in 2027. Whatever applies now might not be valid then. The immigration rules are constantly changing.

There will be general elections in the UK in less than a year and it's highly likely that a new government will bring changes to the existing legislation in terms of immigration.

Focus on doing the right thing whilst living in the UK.

There is no need or relevance for that. You are worrying unnecessarily.

Thank you for your advice. I should look forward rather than being worried too much.
