ILR Eligibility date advice - SET(O) dependant - delayed entry because of Covid

Post by mastidl » Mon Jul 07, 2025 11:47 am

Hi,

This is regarding my spouse ILR eligibility date. I came in Jun 2019 on Tier-2 visa and got ILR in May 2024. I am going to apply for my spouse ILR this year but I am confused about the date of eligibility.

My spouse applied for the PBS dependent visa on 5 Feb 2020 from India and got the visa approved with validity dates - 31 Mar 2020 to 30 Apr 2020. My spouse was planned to travel from India on 05 Apr 2020 But due to covid, flights were cancelled and could not able to travel. As my spouse could not able to travel during the visa validity time frame, the visa vignet became invalid and had to apply again.

new application date was around 15 Jul 2020 and got the visa approved with validity dates - 9 Aug 2020 to 11 Nov 2020. My spouse entered UK on 23 Oct 2020.

So my question is will my spouse eligible by 12 Jul 2025 or 25 Sep 2025(23 Oct - 28 days) because she entered after 6 months of initial visa date ?

Could you please help me on this.

Sorry if this is asked already.

Thanks

Her qualifying period counts from very first visa approval, so it counts from 31 Mar 2020. She is already eligible for ILR

I have one question regarding ILR application for PBS dependants. I did not see anything related to proof for the cohabitation for last 2 years for the spouse/partner in the checklist of documents to submit. Do we still need to submit the proofs for the last 2 years ?

My spouse is submitting the family consent where part 1 singed by her and part 2 is signed by me.

Could you please confirm.
