ILR Eligibility date advice - SET(O) dependant - delayed entry because of Covid

Post by mastidl » Mon Jul 07, 2025 11:47 am

Hi,

This is regarding my spouse ILR eligibility date. I came in Jun 2019 on Tier-2 visa and got ILR in May 2024. I am going to apply for my spouse ILR this year but I am confused about the date of eligibility.

My spouse applied for the PBS dependent visa on 5 Feb 2020 from India and got the visa approved with validity dates - 31 Mar 2020 to 30 Apr 2020. My spouse was planned to travel from India on 05 Apr 2020 But due to covid, flights were cancelled and could not able to travel. As my spouse could not able to travel during the visa validity time frame, the visa vignet became invalid and had to apply again.

new application date was around 15 Jul 2020 and got the visa approved with validity dates - 9 Aug 2020 to 11 Nov 2020. My spouse entered UK on 23 Oct 2020.

So my question is will my spouse eligible by 12 Jul 2025 or 25 Sep 2025(23 Oct - 28 days) because she entered after 6 months of initial visa date ?

Could you please help me on this.

Sorry if this is asked already.

Thanks

Her qualifying period counts from very first visa approval, so it counts from 31 Mar 2020. She is already eligible for ILR

I have one question regarding ILR application for PBS dependants. I did not see anything related to proof for the cohabitation for last 2 years for the spouse/partner in the checklist of documents to submit. Do we still need to submit the proofs for the last 2 years ?

My spouse is submitting the family consent where part 1 singed by her and part 2 is signed by me.

Could you please confirm.

Yes.
Read: All you need to know about cohabitation evidence

Sounds good

Thanks Zimba.

I need little help on below matter.

this is regarding "when did you leave UK and crown dependencies". My spouse left the country on 30 Mar at 3:10pm but while filling the application form she mistakenly entered the arrival date at the destination which is 31 Mar.

So the date of leaving UK is entered as 31 Mar instead of 30 Mar. Application was submitted already so cant change it now

Is this a problem ? do we need to submit any cover letter for that ? or is it okay to leave and do nothing?

Thanks

My spouse and kids applied for ILR and biometrics are done on 2 Aug 2025.
The application submitted using priority service and the response should be received by Friday 8 Aug.
But there is no response at all.

No email about missing details/additional documents/information but complete silence from UKVI. I even check the e-visa and there is no status change.
So should we wait or reach to UKVI to check about the application ?

Thanks

thanks Zimba.

Got the approval email for today for all applications. Next step try and request for a refund.

Should I call them or email them for a refund ?

Congratulations :D
Refunds are often given automatically.

See:

Immigration and nationality refunds policy
Process to request a refund for services relating to an immigration application or service
we have sent an email on 14 Aug for the refund mentioning the reason that UKVI was on complete silent on the application and did not give us the approval within the mentioned timelines. They have responded stating that the priority service fee will be refunded.

Thanks for all the help.
